The website www.fundacaolivrarialello.pt (hereinafter referred to as the "FUNDAÇÃO LIVRARIA LELLO website") is the exclusive property of Lionesa Associação de Arte, Cultura e Turismo (hereinafter referred to as the "Association"), with the corporate number 514 883 030, headquartered at Quinta do Mosteiro de Leça do Balio, Lugar da Igreja, Rua do Mosteiro, S/N, 4465-703 Leça do Balio.

GLOSSARY

User: The person who has accessed the FUNDAÇÃO LIVRARIA LELLO website but has not yet registered.

Registered User: The individual or corporate entity who has accessed the FUNDAÇÃO LIVRARIA LELLO website and registered to access the ONLINE STORE and purchase products and/or services from the Association, subscribe to the Association's Newsletter, make a visit to the virtual space of the FUNDAÇÃO LIVRARIA LELLO, participate in quizzes and other initiatives promoted by the Association.

Username: The identification of the REGISTERED USER.

Password: The access key to the REGISTERED USER's personal account and reserved area, created and exclusively managed by them.

Online Store: A reserved space on the FUNDAÇÃO LIVRARIA LELLO website where the list and information about the products and services sold by the Association (FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES) are made available to any REGISTERED USER, allowing them to make purchases electronically.

Products/Services: Various types of goods and services available on the FUNDAÇÃO LIVRARIA LELLO website, including for sale in the ONLINE STORE.

Customer: A REGISTERED USER who purchased FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES.

Reserved Customer Area: A reserved area on the FUNDAÇÃO LIVRARIA LELLO website where the entire history of the relationship between the customer and the Association is stored, which the Association does not have access to, directly or indirectly.


OBJECT OF THE TERMS AND CONDITIONS [TC]

These Terms and Conditions (hereinafter referred to as TC) are intended to regulate the ordering and electronic acquisition by REGISTERED USERS of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES disclosed and made available through the FUNDAÇÃO LIVRARIA LELLO website, and their sale and delivery by the Association to CUSTOMERS, producing effects in accordance with Portuguese law, particularly with DL 24/2014 of February 14, which regulates distance contracts, especially regarding relevant pre-contractual information. The TC also define the Privacy Policy for access, navigation, and use of the FUNDAÇÃO LIVRARIA LELLO website.

The Association reserves the right to make changes to FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES and their respective prices disclosed and made available through its website at any time without prior notice.

Please read these TC carefully before accessing the FUNDAÇÃO LIVRARIA LELLO website, especially to purchase FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES, subscribe to the Association's Newsletter, make a virtual visit to the FUNDAÇÃO LIVRARIA LELLO, or participate in contests, quizzes, and other initiatives promoted by the Association.

Access, navigation, and use of the FUNDAÇÃO LIVRARIA LELLO website and ONLINE STORE must be free by REGISTERED USERS, presuming that they have read, understood, and accepted these TC without limits or reservations. These TC and, specifically, all contractual information are written in both Portuguese and English. However, the Portuguese version prevails for any legal effects, particularly for the interpretation and integration of any gaps in the TC and legal disputes arising from their application.


PRESENTATION AND DESCRIPTION OF LELLO PRODUCTS AND SERVICES IN THE ONLINE STORE

In this reserved space of the FUNDAÇÃO LIVRARIA LELLO website, the REGISTERED USER finds the following products and services that can be purchased electronically:

Tickets:
Access tickets to the physical space of FUNDAÇÃO LIVRARIA LELLO have different types and associated costs, as detailed below:

Regular Ticket:
Can be purchased online for €0 for the "Act The Thought" exhibition and €8 for the visit to the "Open Sculpture, Siza".

Child Ticket:
Accompanying adults of children up to 12 years old (inclusive) must reserve a child ticket online. If requested by the Association's assistants, they must also present an official proof of the minor's age.

Student/Senior Ticket:
Students and seniors over 65 can reserve a student/senior ticket online for €4. If requested by the Association's assistants, they must also present an official proof of student status or age.

Family Ticket:
Families with two adults and up to three children or students can reserve a family ticket online for €20. If requested by the Association's assistants, they must also present an official proof of the minor's age or student card.

This type of ticket issuance has no associated cost. Tickets must always be shown to the Association's assistants at the entrance to the physical space of the FUNDAÇÃO LIVRARIA LELLO, either in printed or digital version (PDF opened on mobile devices). Without it, access, whether priority or not, will not be possible.


OUTSIDE THE ONLINE STORE

Outside the ONLINE STORE, the Association also provides the following services on the FUNDAÇÃO LIVRARIA LELLO website:

Newsletter:
Subscribing to the Association's Newsletter allows receiving complete and updated information about the respective programming in the email inbox.

Quizzes, contests, and other initiatives:
Participation in quizzes and other initiatives promoted by the Association requires registration by the USER on the FUNDAÇÃO LIVRARIA LELLO website. See below "Registration Rules."

Participation in contests does not require registration on the FUNDAÇÃO LIVRARIA LELLO website, but is done through a "landing page" made available on the digital platforms where the contest is disclosed, where the USER must register for this specific purpose. See below "Registration Rules."


REGISTRATION ON THE FUNDAÇÃO LIVRARIA LELLO WEBSITE

Registration and contracting of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES are only permitted to adults under applicable law.

Contracting FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES in the ONLINE STORE, subscribing to the newsletter, and participating in quizzes and other initiatives of the Association (except contests) outside the ONLINE STORE require prior registration of the USER on the FUNDAÇÃO LIVRARIA LELLO website.

For registration and account creation, the USER must provide the following personal data:

• Name
• Date of birth
• Gender
• Complete address (residence address, including postal code, city, and country)
• Valid personal email address, which should also be the main address for all vital communications regarding the contracting of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES and participation in quizzes and other initiatives of the Association
• Phone number
• NIF (not mandatory)
• The USER must also create their USERNAME and PASSWORD, respecting complexity criteria, which will be unique, personal, and non-transferable. The REGISTERED USER is solely responsible for their proper use and conservation.

Participation in contests promoted by the Association is done through a "landing page" made available on the digital platforms where the contest is disclosed, where the USER must register. For this, they will be asked for "name" and "email address" and, optionally, "phone number" (not mandatory).

The REGISTERED USER must provide correct data and not use false identities, being solely responsible if the associated services are not provided as expected due to incorrect or insufficient information.

After registering on the FUNDAÇÃO LIVRARIA LELLO website, the REGISTERED USER will receive a confirmation message from the Association in their email inbox. If they later want to recover the PASSWORD and have indicated it on the personal account access page, they will receive a new message in the email inbox with the requested information.

In the personal account, the REGISTERED USER will have access to the entire history of their relationship with the Association, which the Association does not have access to, directly or indirectly.


CANCELING NEWSLETTER SUBSCRIPTION

At any time, the REGISTERED USER may decide not to receive the Association's Newsletter. To do this, they must select the "Unsubscribe" option included in all email messages and other communications from the Association, with the respective instructions.


GENERAL RULES FOR USING THE FUNDAÇÃO LIVRARIA LELLO WEBSITE

Violation of any of the TC by REGISTERED USERS results in the unilateral and immediate cancellation of the respective account by the Association without the right to a refund of any amounts paid, and without prejudice to any civil or other liability of the REGISTERED USER and the duty to indemnify for damages suffered when, under the applicable law, they are liable for such damages.

Any attempts to alter the information on the FUNDAÇÃO LIVRARIA LELLO website or any other action that may cause damage and endanger the integrity of the system are strictly prohibited and constitute grounds for the unilateral and immediate cancellation of the account by the Association, without the right to a refund of any amounts already paid, and without prejudice to any civil or other liability. REGISTERED USERS are obliged to comply with the applicable legislation, particularly in matters of computer crime, and are solely responsible for any infractions.

The Association may also cancel an account or withhold amounts paid by the REGISTERED USER due to an order from judicial, administrative, or other competent authorities under the applicable law, without incurring any responsibility or duty to indemnify or compensate by the Association.

REGISTERED USERS must refrain from introducing, storing, or disseminating through the FUNDAÇÃO LIVRARIA LELLO website illegal, defamatory, obscene, injurious, xenophobic content and all that violates general principles of law and public order.

The REGISTERED USER may request the cancellation of their account electronically, that is, by sending an email to the Association at the following address: geral@fundacaolivrarialello.pt.

The request to cancel the account does not affect PRODUCTS and/or SERVICES already contracted and paid, which should follow the contract termination regime. For more details, see: “RETURNING ALREADY PURCHASED PRODUCTS OR CANCELING ALREADY CONTRACTED AND SCHEDULED SERVICES IN THE ONLINE STORE (Right of Withdrawal).”

The Association cannot be held responsible for any damages of any kind caused to REGISTERED USERS resulting from force majeure or unforeseeable circumstances, notably due to network IP overload or the systems supporting the FUNDAÇÃO LIVRARIA LELLO website, potentially causing interruptions, delays, or loss of information.

In case of interruption due to unforeseeable system overloads supporting the FUNDAÇÃO LIVRARIA LELLO website, or because the Association deemed it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, remotely reconfiguring the network settings, the Association commits to regularizing its functioning as soon as possible.

The FUNDAÇÃO LIVRARIA LELLO website contains links to third-party websites, provided solely for the USER's convenience. The Association does not endorse or is responsible for their content, and access and navigation are the USER's exclusive responsibility.


COMMUNICATIONS

Communications with REGISTERED USERS related to the provision and/or electronic sale of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES may be made through the FUNDAÇÃO LIVRARIA LELLO website itself, by telephone, email, or postal mail to the telephone numbers, email addresses, and postal addresses provided by REGISTERED USERS during their registration and ordering process of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES.


COMPLAINTS

REGISTERED USERS may submit information requests and file complaints related to the use of the FUNDAÇÃO LIVRARIA LELLO website, for all purposes mentioned in these TC, directly to the Association through the email address geral@fundacaolivrarialello.pt, which commits to responding within a maximum period of 15 days. Complaints can also be submitted through the Electronic Complaints Book system available here: https://www.livroreclamacoes.pt/inicio.


INTELLECTUAL PROPERTY RIGHTS

All software related to the FUNDAÇÃO LIVRARIA LELLO website, as well as the content, notably text, illustrations, images, or audiovisuals contained therein, and the domain livrarialello.pt, associated trademarks, and logos, and other distinctive signs are the property and exclusive use of the Association and are protected under general law and, where applicable, by national and international copyright and industrial property legislation. Reproduction for personal use is permitted, as well as other free uses authorized by law, and any other use requires prior written consent from the rights holder (the Association).

The intellectual property rights of some content on the website and/or application may, however, belong to third parties, and prior written authorization is always required for use, e.g., reproduction of any such content for purposes other than private use.


DATE OF ENTRY INTO FORCE AND AMENDMENT OF THESE TC

These TC come into force from the date of their posting on this website (online), and may be amended. Amendments take effect from the date of their posting on this website (online), with an express reference to the update date.


APPLICABLE LAW AND JURISDICTION

These TC are governed by Portuguese law. The courts of the district corresponding to the Municipality of Matosinhos have exclusive jurisdiction to settle disputes arising from the interpretation or application of these TC, as well as the provision and sale of FUNDAÇÃO LIVRARIA LELLO PRODUCTS AND SERVICES.
